Man accused of shoplifting uses children to make his getaway

KATY, Texas -  A case of shoplifting turned violent for one Waller County constable.

On Jan. 20, a father and his children were attempting to leave a Walmart on Fry Road in Katy with stolen CDs and DVDs when they were caught. Surveillance video shows the man shoving the employee as his children make a break to get to the car.

Constable Herschel Smith, who works a second job at the store, was called to the scene. Police said that's when the man attacked Smith, punching him in the face. According to officials, the man then told the older child to get into a silver Infiniti SUV with paper tags and start it up. Police said the man hopped into the running car and tried to run Smith over before getting away.
